1. Agreement
www.classnet.com.au is purely an education and training non profit website for use by students and teachers. It is owned by Thornbury High School and it allows for certain content to be uploaded or posted which can then be viewed privately or by the general public.
2. Such posted content may include video, animation, audio, photo, word or other digital work. Our aim is to assist teachers and students to get their creative work published and to make such work more accessible to the wider community. We are providing a publication and training platform for the education fraternity. To participate in the website we require that you follow our rules of conduct to ensure that we can act responsibly in the eyes of the law and the wider community. Once registered we will never pass on your personal information to any third party or give out your email address. We use your information to generate user statistics that help us gain support from partners or sponsors – that in turn helps us stay alive. Given that our aim can only be met if the Website continues to function, if you use the website, we require that you agree to indemnify us and to limitations of our liability. You can delete your account at any time, as well as, any uploaded content for both yourself and your students. We always greatly appreciate your feedback to ensure we are doing the right thing at all times.
3.TERMS AND CONDITIONS
These are the terms and conditions (Terms of Use) between you and Thornbury High School (hereby known as THS) regarding your use of Classnet.com.au. By using Classnet.com.au you agree to be bound by this Agreement. Once you have registered with the Classnet.com.au, you will become a Member. Classnet.com.au allows Members to create a unique personal profile. Student and teacher profiles must not include telephone numbers, street or home addresses, and any photographs containing nudity, or obscene, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other Members (for instance, in their Profile) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and THS assumes no responsibility or liability for this material. If you become aware of misuse of Classnet.com.au please email admin@classnet.com.au. THS reserves the right, in its sole discretion, to remove any posting by you that is contrary to this Agreement for any reason and without liability. Classnet.com.au is offered and made available only to student and teachers whether they are at a state, private or religious school. By becoming a teacher member of Classnet.com.au, you certify that you are currently a registered teacher employed at a registered school. This Agreement will remain in full force and effect as long as you are a user of Classnet.com.au
4.REGISTRATION
When you sign up to become a Member, you will also be asked to select and provide a unique Member profile and password. Please read THS Privacy Statement, which describes the personal information we collect, use, disclose, manage and store. You may not allow any others to use your Member profile and password under any circumstances. THS is not liable for any harm caused or related to the theft or misappropriation or disclosure of your Member profile and password. You agree to immediately notify classnet.com.au if you become aware of any unauthorised use of (or activity using) your Member profile or any other need to deactivate your Member profile due to security concerns.
5.MODIFICATIONS
THS reserve the right, at any time and from time to time, for any reason within THS's sole discretion, to change the terms of this Agreement. THS will post or display notices of material changes on classnet.com.au. Once we post them on, these changes become effective immediately and if you use classnet.com.au. after they become effective it will signify your agreement to be bound by the changes. You should check back frequently and review the terms and conditions of this Agreement regularly so you are aware of the most current rights and obligations that apply to you and the terms and conditions of your agreement with THS. THS also reserves the right to change, modify, withdraw, suspend or even permanently discontinue all or any portions of classnet.com.au at any time, without any liability or obligation to you, with or without notice.
6.Privacy
Please see our Privacy Statement regarding the collection and use of your Personal Information in connection with your use of classnet.com.au. If you have any questions regarding THS's privacy practices, you may send your question to us by e-mail to admin@classnet.com.au.
7.OWNERSHIP AND PROPRIATARY ISSUES
I authorise the use or reproduction of any content that is posted by me for any reasonable purpose within the discretion of THS without acknowledgment and without being entitled to remuneration or compensation.
8.COPYRIGHT
You should be aware of any Australian law in regard to copyright in relation to all your posted content on Classnet.com.au. It is your responsibility to make sure that no copyright is infringed and that you understand you are solely responsible for any such infringements.
9. Music
In regards to music, you are fully responsible for the clearance of any music or sound contained in your content. If any record company or music publisher contacts us about music or sound in the submitted content, we will refer that company to you so be sure to obtain all the appropriate clearances beforehand.
10. COPYRIGHT; CONTENT REQUIREMENT VIOLATIONS; BREACH OF AGREEMENT
If you believe any content on www.classnet.com.au violates the copyright of any other party or violates the terms of this Agreement or in any other way infringes upon the rights of others, you can notify Classnet by email at admin@classnet.com.au
RIGHTS GRANTED TO Classnet
11.In connection with the content you submit, you are authorising Classnet to host, cache and store your content and grant a non-exclusive, worldwide, perpetual and royalty free right and license to use and distribute your content through TV, online and through the mobile phone networks.
12.The rights described in this Agreement and granted to Classnet commence immediately upon submission of content and continues until such time as the content is deleted from the Classnet website. Classnet has the right to include your film or video in its promotional activities. This may include, but is not limited to, the creation of show reels and advertisements physical screenings, viral campaigns, presentations and product pitches.
13.Classnet has the right to compress and package your content for portable distribution including, but not limited to, iPod, PSP and mobile formats.
14.6. OWNERSHIP
15. Classnet does not claim any ownership rights in the content that you submit to www.classnet.com.au. Classnet retains all right, title and interest in and to www.classnet.com.au including, but not limited to all associated intellectual property and proprietary rights existing anywhere in the world and you acquire no ownership, proprietary or other rights, title or interest in or to the www.classnet.com.au website.
16.You must own the rights to the content you submit and each element of the content you submit and the right to grant all of the authorisations, rights and licenses described in this Agreement. If you do not exclusively own all of these rights, you must have all necessary authorisations, permissions, approvals, consents, rights and licenses from the owner(s) to enter into this Agreement, perform and comply with all of its obligations.
17.RULES OF CONDUCT
Classnet.com.au may delete any content posted that violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person.
On notice, THS will act expeditiously to remove content on classnet.com.au that infringes the copyright rights of others. If you believe that any content on classnet.com.au violates any of the terms or conditions of this Agreement or infringes copyright in your work, please send us an email at admin@classnt.com.au You are solely responsible for the content that you post on or through classnet.com.au including any work or comments that are posted by yourself or any of your students.
No posted content that is in any type of format can be:
libelous, defamatory, obscene, pornographic, sexually explicit, racially degrading, harassing, intimidating, threatening, hateful, discriminatory, or abusive;
affects us adversely or reflect negatively on the Website
is for commercial or business purposes because it may adversely affect THS's ability to gain support from third parties that assists the Website to continue;
transmits, distributes or uploads programs or material that contain malicious code, such as viruses, time bombs, cancel-bots, worms, Trojan horses, spyware, or other potentially harmful programs or other material or information;
18.HYPERLINKS TO THIRD PARTIES
The appearance, availability, or your use of URLs or hyperlinks referenced or included anywhere on Classnet.com.au does not incur any obligation, responsibility or liability on the part of THS.
19.TERMINATION OF REGISTRATION
You may terminate your registration and Member profile, at any time and for any reason by e-mail to admin@classnet.com.au and requesting termination of your registration. We may terminate your use of and registration on the Website, at any time and for any reason.
20.Disclaimer and limitations of liability
You acknowledge and agree that you are assuming the entire risk of using Classnet.com.au
YOU UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER THS, ITS AFFILIATES, OR ITS OR THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, NOR ANY OF ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, REPRESENTATIVES, SERVICE PROVIDERS, ADVERTISERS, OR SUPPLIERS, SHALL BE LIABLE FOR ANY LOSS OR DAMAGE, OF ANY KIND, DIRECT OR INDIRECT, IN CONNECTION WITH OR ARISING FROM USE OF CLASSNET.COM.AU INCLUDING, BUT NOT LIMITED TO, COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES, REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THS assumes no liability, responsibility or obligation to transmit, process, store, receive transactions or for any failure or delay associated with any transactions and you are hereby expressly advised not to rely upon the timeliness or performance of classnet.com.au for any transactions.
21.Indemnification
You agree to indemnify, defend and hold THS, its Affiliates and its and their respective officers, directors, employees, agents, licensors, representatives, Advertisers, sponsors, service providers and suppliers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable legal costs), resulting from any breach or violation of this Agreement by you, or resulting from any content you provide, post, submit or make available on or through classnet.com.au or your unauthorised use of any content.
22.Severability
If any provision of this Agreement is held to be illegal, invalid or unenforceable by a court of competent jurisdiction, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of this Agreement shall remain in full force and effect.
23.Law that applies to this agreement This Agreement is made in the State of Victoria, Australia, and is governed by the non-exclusive jurisdiction of the courts of the State of Victoria, Australia.
